Tech Think Tank Challenges FAA Drone Registration

Files Petition For Review In D.C. Court

A second lawsuit against the FAA related to its UAV registration rule has been filed in the District of Columbia Court of Appeals.

The suit was filed by the think tank TechFreedom, according to Forbes contributor John Goglia.

The petition challenges the FAA's new rule as a violation of Section 336 of the 2012 law that reauthorized the FAA. That section prohibits the agency from creating  ”any rule or regulation regarding a model aircraft.” Tech Freedom also says the FAA has exceeded its authority because the new rule requires the registration of the individual who owns the aircraft rather than the aircraft itself. Finally, the group says that because the FAA did not provide public notice or an opportunity for public comment on the rule, its implementation was "arbitrary, capricious, and abuse of discretion."

Friday is, as you probably know, the last day for persons who already own a UAV that weighs over .55 pounds to put their name on the FAA's registration database. Flying an unregistered drone this weekend could result in some hefty fines and penalties ... if you get caught.

On their Facebook page, TechFreedom says their purpose is to "embrace technological change, pushing back against the technocrats who fear it & reactionaries who would control it."
