Horse Racing Organization Sues Air Charter Operation

Breeders Cup Says AirCharter.com Violated Contract

A lawsuit has been filed in Fayette County, KY Circuit Court accusing an air charter operation of violating its contract with Breeders Cup over the transportation if some 60 horse racing patrons from California to Kentucky following the World Championships at Santa Anita Park.

Breeders Cup ltd. claims that it paid AirCharter.com $104,220 for the charter service with the stipulation that if the company cancelled the flight in less than seven days it would refund the entire amount.

According to the website Blood Horse, when a conflict arose, AirCharter said it could secure a different airplane, but it would have to charge Breeders Cup an additional $45,469.31. Breeders Cup said "no thank you" and went with a different company. AirCharter reportedly did not return any of the money.

Breeders Cup is looking to get its money back, citing breach of contract. The organization said it would have no other comment. AirCharter.com has not filed a response to the lawsuit, according to the report.
