Florida Man Jailed For Blocking Helicopter Reaches Plea Agreement

Charges May Be Dismissed If Physician's Assistant Stays Out Of Future Trouble

A physician's assistant who blocked a helicopter landing zone with his car at the scene of a fatal accident may avoid further jail time after reaching an agreement with local authorities.

Charges against the Volusia County, FL physician may be dismissed provided by attends a restorative justice course as part of a deferred prosecution agreement, and stay out of trouble for three months. James Lee Allen must also admit that the accusations leveled against him were "true and correct," according to the Daytona Beach News Journal.

Allen had driven around fire trucks at the scene of a fatal automobile accident and then refused to move his car which was blocking a helicopter landing area. State Attorney R.J. Larizza's spokesman Spencer Hathaway said that Allen qualified for a "deferred prosecution because he had no criminal history whatsoever" had spent a night in jail on a misdemeanor charge, an agreed to participate in a restorative justice program. After he completes the conditions, he will be eligible to have his case dismissed.
