Prosecutors Say Settlement Near In Wagstaff Case

Scheduled Court Date Passes Without Resolution

Patty Wagstaff was scheduled to appear earlier this week in a Winnebago County courtroom in connection with her arrest on drunk driving charges July 31 at EAA AirVenture.

As ANN reported Wednesday, as of Tuesday night there was no word on the outcome from the court... but now, the Oshkosh Northwestern reports Wagstaff did not appear, and quotes Winnebago County District Attorney Christian Gossett as saying his office is close to a settlement with defense attorneys.

The 57-year-old airshow performer was issued citations for first-offense operating while intoxicated, and refusing to take a test for intoxication. She was stopped on the grounds of Wittman Regional Airport sometime after 10:30 pm July on 31.

Days after the alleged incident, Wagstaff told ANN she was "in the wrong place at the wrong time" and was horribly embarrassed at what transpired. Wagstaff was initially charged with two violations -- operating while under the influence, and refusal to take a breathalyzer test. She vigorously denies she was impaired.

Wagstaff has suggested the actions of airport security were inappropriately escalated, and the Winnebago County Sheriff's office should never have been involved.
