Court Rules Germany Liable For 2002 Midair

Germany will have to reimburse a Russian airline for the cost of its Tupelov 154... after that plane and a DHL Boeing 757 cargo flight collided near the Swiss border four years ago.

All 57 passengers and 12 crewmembers were killed in that mid-air... blamed on a Swiss Skyguide controller officials say wasn't paying attention when the two planes collided.

Now how is it that Germany is liable for the actions of a Swiss air traffic controller? The German court ruled that the government was responsible for contracting with Skyguide to cover flights in that part of the country.

This is the first of several lawsuits in the works after the July 2002 mid-air. DHL wants about $50 million in damages.

An insurance company contracted by Skyguide is suing the Russian airline... Bashkirian. The families of at least 30 people killed in the collision are suing and seven Skyguide workers now face criminal charges.
